MIB Claims – Uninsured Driver Accident

The Motor Insurers Bureau compensates the victims of uninsured drivers for both the damages they sustain, including personal injury, as well as legal expenses. Before the victim receives their compensation, judgement must first be obtained in the County Court at which time the judge determines the amount of compensation that the victim is owed. The MIB pays the victim directly. The negligent driver is then obligated to reimburse the MIB for the amount it paid to the victim.

In addition to accidents caused by uninsured motorists, the MIB also compensates victims of untraced hit and run drivers. The victim will be compensated for their personal injuries. However, the victim may or may not be compensated for property damage dependent on the circumstances of the case. The costs of the property damage must meet a minimum threshold for the victim to receive compensation. If the total damage falls below this minimum, the victim will not receive compensation for their destroyed property. Also note that the MIB does not compensate victims of hit and run drivers for legal expenses.
