What is Litigation? - This fundamental aspect of law involves the conduct of legal action by an individual or by a limited company with the aim of settling a dispute in order to receive compensation or to benefit from some other civil remedy such as an injunction. This process is usually dealt with by a litigation solicitor and can be carried out in a court of law or it can be carried out without reference to a court of law. Litigation in personal injury cases usually starts with the claimant sending out a formal letter of claim to a proposed defendant. If the defendant admits liability and settles the action then there is not usually any necessity to refer the matter to a court of law. If the defendant fails to deal with matters properly then the claimant can issue legal proceedings and the litigation continues to a conclusion in the court. A claimant is usually represented by a litigation solicitor in court proceedings although an individual may represent themselves in court without the necessity to employ a litigation solicitor. A limited company must however normally be represented by a litigation solicitor in any court proceedings and cannot represent themselves as a claimant or defendant in person. Litigation can be a complex process and particularly in personal injury cases where there may be large sums of money at stake it is advisable for both sides to be represented by a litigation solicitor. A defendant insurance company will almost certainly be represented by a litigation solicitor and a claimant in person would be at a considerable disadvantage if they were not also represented by a litigation solicitor.
