UK Accident Compensation Claims - Damages Awards

In order for the court to make an award in an accident compensation claim the amount of the damages suffered must first be determined. The difficulty with calculating compensation is that not all damages can be objectively assessed in terms of hard numbers. Because of this difficulty, damages are divided into two categories: special damages and general damages. Special damages comprise the value of items lost or damaged in the accident that can be calculated with a degree of precision. General damages cover the victim's non-monetary suffering and more obscure losses that must be assessed. The amount of special damages awarded is left up to the judge's discretion.
