Criminal Injury Compensation Authority
The United Kingdom created an administrative body dedicated to providing victims of violent crime compensation for their injuries and financial losses. This body is known as the Criminal Injury Compensation Authority, referred to as CICA for short. CICA offices are located in both London and Glasgow. Northern Ireland has a separate compensation scheme that is administered by a public body located in Belfast.
CICA Compensation Claims
The CICA exists to award damages to victims of violent offences in areas such as physical injuries, mental trauma and related financial losses. Each year the CICA pays out more than £200,000,000 in damages to victims of violent crimes. You are eligible to bring a UK criminal injury claim even if no conviction is made or your assailant is unknown.
The CICA Tariff Scheme
A "tariff scheme" is employed to place a monetary value on the victim's injuries. A wide variety of injuries have been assigned a value by the CICA. These injuries are then classified into "bands" with corresponding awards ranging from £1,000 to £250,000. When determining the amount to be awarded, the CICA considers only the victim's three most serious injuries. The value of all three injuries is not lumped together into an aggregate sum. Rather, the CICA discounts the second and third least serious injuries by a set percentage. Victims can also be compensated for pain and suffering up to a cap of £250,000. The CICA has the authority to increase a victim's award by an additional £250,000 based on lost wages and other special expenses. All totaled, a victim can potentially receive a maximum award of £500,000.
CICA Appeals
Sometimes a victim is dissatisfied with the amount awarded by the CICA or feels that it does not adequately represent the severity of their injuries. In those cases, the victim has the right to appeal the award to the CICA Appeals Panel. The Appeals Panel reviews the application and then decides whether to uphold the CICA's decision or order that a different amount be paid. The CICA is bound by the Appeals Panel's decision.
