Assault Compensation Claim Eligibility & Requirements

Victims of violent crimes can seek compensation for their injuries through the CICA. In order to bring an assault compensation claim, the following requirements must be met :-

  • You must submit your claim, in writing, to the CICA within two years of the violent incident. It is not necessary for the perpetrator to be identified or convicted in order to receive compensation. The CICA has the authority to extend this time period in rare circumstances.
  • The incident must have been promptly reported to the police or other appropriate authority and the victim must give full co-operation with any prosecution.
  • Your injuries must have lasted for a minimum of six weeks must have required a minimum of two visits to a physician.

Assault Compensation Tariff Scheme

A tariff scheme in bands ranging from £1,000 to £250,000 is used to calculate the victim's injury payment. The CICA may compensate the victim for other losses up to a maximum amount of £250,000. Possible areas of compensation include medical expenses and lost wages. The precise amount of compensation a victim is awarded depends on a number of factors. For example, the CICA will consider the victim's behaviour before, during and after the violent incident. It will also consider the victim's criminal record of "unspent" convictions.

CICA Reviews & Appeals

A claimant who is unhappy with the amount of compensation they have been awarded has a right to have the award reviewed by the CICA. If the victim is still dissatisfied after the review, they have a right to have the matter reconsidered by the Criminal Injuries Compensation Appeals Panel.
