Criminal Injury Compensation Authority Review
Following notification of the final award by the CICA the claimant has the right to ask for a review prior to formal appeal. The Criminal Injuries Compensation Appeals Panel will only consider an application against a decision on formal CICA review. On review the amount of the award can be increased, decreased or withdrawn if the original amount is deemed unfair or inappropriate.
CICA Review of the Medical Evidence
The long-term consequences of a victim's injuries are not always apparent from the outset. Unfortunately, a victim's medical condition may unexpectedly worsen after the CICA's final decision has been rendered. In those cases, the CICA has the authority to reopen the claim and adjust the amount of compensation. The standard for determining whether the case will be reopened is whether the original amount of compensation would cause an injustice if allowed to stand. Victims who are experiencing setbacks with their medical condition should not delay in seeking the assistance of a solicitor. The law limits the time period for reopening cases to two years. The time period, however, can be extended in exceptional circumstances.
Final Appeal of a CICA Compensatory Award
Claimants may make a final appeal of the amount of the award to the Criminal Injuries Compensation Appeals Panel. Generally the Appeals Panel must receive the application within 90 days of the date of the final review by the CICA. If the Appeals Panel believes it would be in the interest of justice to do so, it may waive the 90-day time limit. Both the appellant and the CICA will receive written notification of the Appeal Panel's ruling, along with an explanation of how the decision was reached. The CICA is obligated to enforce the Criminal Injuries Compensation Appeals Panels ruling.
